Filing Confidential Information:
  • Most documents have no confidential information.
  • You may claim confidential information only for energy, water, telecommunications, or solid waste companies.
  • To submit a document with confidential or highly confidential information, you must comply with WAC 480-07-160 and any protective order.
      Any provider claiming that information provided to the commission is exempt from disclosure must make that claim in writing via Cover Letter at the time the provider submits the document containing the information. The provider must also state the basis for the claim of exemption at the time the provider submits information claimed to be exempt per WAC 480-07-160(4)(a)
      This includes submitting both a complete document that is marked confidential, with the confidential information shaded, and another document with the confidential information redacted. If you fail to comply with these requirements, your filing will be considered incomplete. Please reference WAC 480-07-160(4)(c)
      The provider must clearly mark each copy of the document with the designation, "Shaded information is designated as exempt per WAC 480-07-160" on the first page of a multipage document and on each specific page that the provider claims contains exempt information per WAC 480-07-160(4)(c)(i)
      The confidential and redacted documents should mirror each other per WAC 480-07-160(5)(c)(iii)
  • The file names for all documents that are designated as confidential must end with (C). The redacted versions must end with an (R).
  • Cover letter should reference WAC 480-07-160 and indicate the justification/reasoning for confidential designation
  • when a protective ordered is issued in certain adjudications, please follow WAC 480-07-160 and WAC 480-07-420
